Terms of Use

1.TIMOMAX Platform

TIMOMAX is a technology and information platform designed to connect animals and people with animal-related information, resources, organizations, services, and community members.

Features may include Ask TIMOMAX, animal listings, shelters and rescues, fostering, adoption resources, transportation, veterinary resources, emergency-resource discovery, lost-and-found services, pet support, community features, pet-service providers, wellness information, data and intelligence tools, and other animal-related services.

Unless TIMOMAX expressly states otherwise, TIMOMAX is not itself a veterinary practice, animal hospital, shelter, rescue organization, adoption agency, foster organization, transportation company, law firm, emergency-dispatch service, governmental agency, or provider of third-party services listed on the Platform.

TIMOMAX primarily provides technology, information, discovery, communication, and connection tools.

2.Ask TIMOMAX and Artificial Intelligence

Certain Platform features use artificial intelligence.

AI-generated responses may be inaccurate, incomplete, outdated, misleading, or inappropriate for a particular situation.

You acknowledge that AI output is generated automatically and should not be treated as independently verified professional advice.

You are responsible for evaluating information obtained through Ask TIMOMAX before acting upon it.

TIMOMAX does not guarantee the accuracy, completeness, reliability, availability, or suitability of AI-generated output.

3.No Veterinary Relationship

TIMOMAX is not a veterinary clinic and Ask TIMOMAX is not a veterinarian.

General animal-health information provided through TIMOMAX is for informational and educational purposes and is not a diagnosis, prescription, treatment plan, or substitute for examination and advice from a licensed veterinarian.

Use of TIMOMAX does not, by itself, create a veterinarian-client-patient relationship.

Do not administer, discontinue, change, or adjust prescription medication based solely on AI-generated information from TIMOMAX.

4.Emergencies

TIMOMAX may help users locate emergency veterinary hospitals, animal services, shelters, rescues, poison resources, transportation, or other resources.

TIMOMAX IS NOT AN EMERGENCY DISPATCH SERVICE.

TIMOMAX does not guarantee that any veterinarian, hospital, rescue, shelter, foster, transporter, volunteer, government agency, or other provider is open, available, appropriately equipped, willing to assist, or able to respond.

Third-party hours, capacity, services, and availability can change at any time.

In a potentially life-threatening animal emergency, contact an appropriate veterinary emergency provider directly and do not delay professional care while waiting for TIMOMAX, another user, or a participating organization to respond.

If a person is in immediate danger, contact the appropriate official emergency service.

5.No Guarantee of Rescue or Outcome

TIMOMAX cannot guarantee that any animal will be rescued, fostered, adopted, transported, treated, funded, located, reunited, placed, or otherwise assisted.

TIMOMAX also does not guarantee any particular medical, behavioral, adoption, rescue, placement, or other outcome.

6.Independent Organizations and Providers

Shelters, rescues, veterinarians, fosters, transporters, volunteers, groomers, trainers, boarding providers, pet cafés, retailers, pet-service providers, and other organizations or individuals appearing on TIMOMAX may be independent third parties.

Unless expressly stated otherwise, TIMOMAX does not employ, control, supervise, operate, or assume responsibility for those parties.

Users are responsible for independently evaluating third-party providers before transferring an animal, purchasing services, making payments, donating funds, providing personal information, or otherwise relying on them.

A listing, profile, badge, search ranking, match, recommendation, or appearance on TIMOMAX does not constitute a guarantee of safety, quality, licensure, honesty, suitability, or outcome.

7.Animal Transfers, Fostering and Adoption

TIMOMAX may facilitate introductions and communications relating to rescue, foster, adoption, surrender, transport, or placement.

Unless expressly agreed otherwise in writing, TIMOMAX is not a party to transactions or agreements between users, shelters, rescues, adopters, fosters, transporters, or other third parties.

The parties involved are responsible for screening, identification, contracts, veterinary records, ownership verification, licensing, transportation arrangements, home checks, safety precautions, and compliance with applicable law.

8.User Content

Users may be able to submit animal listings, photographs, videos, comments, messages, rescue alerts, reviews, lost-and-found information, fundraising information, and other material (“User Content”).

You represent that you have the necessary rights to submit your User Content and that doing so does not violate law or third-party rights.

You remain responsible for your User Content.

By submitting User Content, you grant TIMOMAX a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, display, distribute, format, adapt, and use that content as reasonably necessary to operate, improve, secure, market, and provide the Platform, subject to applicable law and our Privacy Policy.

TIMOMAX may moderate, restrict, remove, or decline to distribute content at its discretion, subject to applicable law.

9.Prohibited Conduct

You may not use TIMOMAX to:

• abuse, exploit, injure, sell unlawfully, or facilitate cruelty toward an animal;
• create fraudulent rescue or adoption listings;
• impersonate another person, shelter, rescue, veterinarian, business, or governmental organization;
• solicit money through fraud or deception;
• intentionally provide false emergency information;
• harass, threaten, stalk, or exploit another user;
• publish another person’s private information without authorization;
• distribute malware or interfere with Platform security;
• scrape, harvest, copy, or commercially exploit TIMOMAX data without authorization;
• circumvent Platform security or access controls;
• use TIMOMAX for unlawful activity; or
• use automated systems to abuse or materially burden the Platform.

TIMOMAX may remove content, suspend accounts, preserve evidence, or cooperate with appropriate authorities when reasonably necessary.

10.Location Information

Some features may use approximate or precise location information to identify nearby resources, animals, organizations, emergencies, or services.

Users control location permissions through their device or account settings where applicable.

Location information and distance calculations may be inaccurate.

Users should independently confirm an address and destination before traveling or transporting an animal.

11.TIMOMAX Intelligence

Statistics, forecasts, capacity information, government information, funding data, trends, recommendations, and other intelligence may be derived from public records, participating organizations, third-party providers, community submissions, estimates, models, or AI-assisted analysis.

TIMOMAX may distinguish verified information from estimates or AI-generated analysis where appropriate.

Forecasts and estimates are not guarantees.

12.Payments, Donations and Fundraising

TIMOMAX may now or in the future facilitate payments, donations, fundraising, subscriptions, sponsorships, or other transactions.

Additional terms may apply to those services.

Unless TIMOMAX expressly identifies itself as the recipient, TIMOMAX does not control how an independent recipient uses money received through or in connection with the Platform.

Payment processing may be performed by independent payment processors subject to their own terms.

13.Accounts and Security

You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account.

You agree to provide materially accurate account information and promptly notify TIMOMAX of suspected unauthorized access.

14.Intellectual Property

The TIMOMAX name, logos, software, interfaces, databases, algorithms, designs, original content, documentation, trademarks, and other proprietary materials are owned by TIMOMAX or its licensors.

Except as expressly authorized, no rights are granted to reproduce, modify, distribute, sell, reverse engineer, scrape, commercially exploit, or create derivative works from TIMOMAX proprietary materials.

15.Third-Party Services

TIMOMAX may link to or integrate with maps, payment processors, veterinarians, shelters, governmental websites, rescue organizations, businesses, social networks, and other third-party services.

TIMOMAX does not control independent third parties and is not responsible for their content, policies, availability, conduct, security, or services.

16.Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIMOMAX AND THE PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TIMOMAX DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND FITNESS OF INFORMATION OR SERVICES FOR A PARTICULAR ANIMAL OR SITUATION.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

17.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMOMAX AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PLATFORM.

This includes, to the extent permitted by law, losses resulting from reliance on AI output, third-party information or conduct, unsuccessful rescue or placement efforts, unavailable resources, inaccurate listings, service interruptions, or user-generated content.

Any limitation applies only to the maximum extent enforceable under applicable law.

18.Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TIMOMAX and its affiliates, directors, officers, employees, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Platform, your User Content, your material violation of these Terms, or your violation of another person’s rights.

19.Suspension and Termination

TIMOMAX may suspend, restrict, or terminate access for violations of these Terms, fraud, threats to animal or human safety, security risks, abuse, or other conduct that materially threatens TIMOMAX or its community.

20.Governing Law

Except where applicable law requires otherwise, these Terms and disputes concerning them will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

The appropriate dispute-resolution, venue, arbitration, class-action waiver, and jury-trial provisions will be set forth in TIMOMAX’s final Terms after review by qualified counsel.

21.Changes

TIMOMAX may update these Terms as the Platform evolves. Material changes will be communicated as required by applicable law.

The effective date appears at the beginning of these Terms.
